Crispy Designs is back up and running!

Right, it's been a weird old time recently with having to rekindle my freelance design clients and decide what to do with Crispy Designs. I'm back doing both now with just 2 hard and fast rules - NO KTM & NO RED BULL LOGOS

The best quality super sticky MX vinyl and laminate (Dakar tested!), thermal printer that produces solid vibrant colours (the only way to get a KTM matched orange!), chrome, gold and silver foils and full custom designs. Yay!! I will be in touch after the dawn to dusk!! No point getting nice graphics yet as it'll be thrown around a slate quarry!!

I think I'm gonna go for a Levi sherwood replica type look, or the ronnie renner x games setup!!

Copyright !! I have recently been speaking with KTM re a trophy we have done in our workshop with reference to this , the Logo is a no no without consent and the lettering is specific , the use of KTM as typed here is fine ... so they told me

As a example my ex has a T shirt with " I have riden the KTM " which is a national railway

a grey area could be with reference to a motorbike , but that would need clarification

Red Bull is just way too risky to print, too many 'stories' of printers being slammed with fines and court cases. KTM is a little different, a few months ago there was 2 licences given to decal printers in the UK. Almost everyone else was sent Cease and Desist letters regarding the KTM logo. Anyone seen to be continuing would be pursued legally and fined.

KTM, as I understand, have copyright over the letters being used in that order on produce associated with motorbikes and 4 wheeled vehicles. I may not be 100% correct but it's a financial risk I can't take.

Yer I reckon so also , I am going to get it checked out though , am seeing my brother in law this weekend and he is a senior partner at a big wig law firm in London and is a specialist in copyright and Patent law , it must be such a grey area and I am interested to know where the cut off point is , but agree not worth the trouble

Ktm are idiots!! I know they're worried about snides and stuff but hey it gets the name out there!! I mean we want Ktm on our bloody Ktm bikes!! Plonkers!!

Yeah crispy I'll deffo be in touch for some of your arty flair!! Glad you're back in the game!! I still love that early set you done where all the brand names were switched for piss takes!!! Great idea!!

An arbitrary mark receives the most protection since the name bears no relationship to the product -- it implies imagination and thought. Kodak is an example of an arbitrary mark because the name itself suggests no connection to film or camera equipment. We learn this association only after the name has been used and becomes associated with the source of that product. A descriptive mark receives protection if it has secondary meaning in consumers' minds. A generic mark rarely receives protection because it is naturally associated with something in consumers' minds. An ordinary description is not special enough to warrant protection. However, if consumers connect the mark and its source in a way that would not exist without the mark's use in commerce, then the mark can be protected.

Alphabet letters, initials, abbreviations and acronyms may be entitled to protection if they are so original that they constitute an arbitrary mark (e.g., NICAD for nickel cadium). Otherwise, they may be protected only if they had acquired a secondary meaning which means that consumers have come to recognize the mark and associate the goods with a particular manufacturer (e.g., IBM and BMW).

So you are correct the letters in any form cannot be used as you can bet KTM have covered all 4 levels of the lettering KTM

That's pretty much as I understood it too. As KTM covers 2 wheels (Road, offroad and cycles) and 4 wheels (Quads and the Road and track going X-Bow) it's pretty much covered that the letters K, T and M if used together are associated with the KTM brand.

You win some and you lose some. I can still produce custom decals for your bikes and promote your own taste. C

It does make me laugh that KTM are happy to have what will be most KTM dirt bikes being ridden without KTM written on them. Go figure.

How is it that MBX graphics seem to be able to sell graphics with whatever they like printed on them?

In the event of a claim they would need to prove it was you who designed and printed products with the above mentioned logos.

So a few cash deals with no 'cripsy' logo attached to the decals and delete the designs after print and Bobs your aunt when in drag. In short, the system is there to be screwed like they would screw you if they could.

Fuck 'em.

Mmmmm, What about just the K & part of the T ie: 950sm tank panel but perforated to stop those dammed bubbles

why not have K T M but written through each letter Keep Taking Money .......

and what happens if u bought the bike second hand and they were already on there ???

so how much money are we talking for an exc200 09 model & my sons 02 50pro junior lc
